1.0“I am so disappointed by our justice system. I sat through a proceeding on May 6th in support of a local contractor that was attempting to collect payment from a local Lavon resident for work completed during the wind storm that took out the bank there in 2023. Neither the plaintiff or the defendant were adequately prepared for court to show proof of damages as they did not have a written contract outside of the insurance estimate but somehow she wound up ruling in favor of the defendants countersuit to the tune of $14,500. The truth is that the defendant in this particular case created chaos as she did not follow what her insurance company had instructed her to do. Judge Ellen Skinner seemed to railroad over the contractor and simply took the word of the defendant that work was not completed when in reality the defendant 1. would not be forthcoming with the insurance documentation 2. had her entire home wripped out by a remediation company after the insurance had already completed their inspection 3. withheld funds for work completed and due to her own negligence the plaintiff was forced to supplement each individual item with the insurance company. The defendant blatantly lied to the judge and stated that the contractor did not finish the fence repairs when in-fact the contractor was not hired to complete the repairs and instead paid for her neighbor to complete it so that she could pocket money from the insurance company. The defendants neighbor admittedly has not finished the fence work due to "weather and his schedule getting in the way". Judge Skinner quickly and very obviously took the side of the single mother female and was against the big bad contractor. She was so rude that she rushed him when it was his turn to speak. Neither one of the individuals in this case deserved a dime as neither one of them proved a thing but somehow Judge Skinner was able to come up with a verdict of $14,500 to the defendant. For what it's worth the contractor did the right thing, he was just unprepared with the facts of the case and he allowed the homeowner to convolute the matter by asking for things that were outside of the scope of what the insurance company had paid her for. Ask me how I know all of this, I'm the one that sold the job to begin with, I was there all along the way and witnessed first hand the chaos that the homeowner created. At this point the defendant should be charged with lying under oath as well as insurance fraud as she pocketed money from the insurance that was intended to repair her home. Be cautious when doing business in Lavon because if it lands in small claims there is strong possibility that you will end up seeing Judge Skinner.”
