Texas Family Law & Domestic Relations

Protecting Parental Rights, Children & Marital Assets under the Texas Family Code

Family law matters are among the most emotionally challenging and legally intricate disputes an individual can face in the Texas legal system. Governed primarily by the Texas Family Code, family jurisprudence balances statutory rules with the discretionary equitable authority of family district court judges. Key issues center around the dissolution of marriage, complex financial divisions, and safeguarding the physical and psychological well-being of minor children.

Texas is a community property state. Under Texas Family Code § 3.002, all property acquired by either spouse during marriage is presumed to be community property subject to a "just and right division" upon divorce, unless proven by clear and convincing evidence to be separate property. In matters affecting the parent-child relationship (SAPCR), Texas courts prioritize the "best interest of the child" standard under § 153.002. Navigating temporary orders hearings, standard possession orders, expanded possession schedules, child support guidelines, protective orders, and mediation requires strategic, compassionate, and unwavering legal counsel.

“My attorney Raya Jackson was THE BEST! She is extremely sharp, takes no prisoners, is a master at executing strategy and thinking on her feet. She ran circles around the opposing council and we walked away with a clear win in our case. She and her team communicated clearly and quickly. She was prepared at every stage though the process which allowed me to be less nervous and anxious during an extremely difficult process. When I was served, I panicked, then called every attorney I could find, so a deep dive on each and interviewed over a dozen. Walters Gilbreath was by far the most thorough in outlining a strategy from day 0. In our initial consult, Brian knew immediately that Raya was the best attorney for the job and I have zero regrets choosing this firm and Raya in particular. If you want to win, get Raya on your side.”

“nI am extremely grateful for the work my amicus attorney, Raya Jackson did during our trial. She demonstrated professionalism, diligence, and fairness throughout the entire process. She was thorough in her investigation, attentive to the facts, and always focused on the best interests of the child. Her reports and testimony were clear, well-prepared, and reflected a deep understanding of the case. I truly believe her efforts played a significant role in ensuring the court had an accurate and balanced perspective. I highly recommend her to anyone needing a dedicated and competent amicus attorney.”

“I hired this very expensive law firm to assist me with a Parental Alienation/Child Custody case and they completely screwed me. They are very expensive, and I thought that meant they would be accountable and professional but that was not my experience. I was 1st assigned a lawyer who actually laughed when I told her my situation instead of showing empathy. Then after months of mediation and court filings and meetings, she proceeded to miss a court deadline that she didn't even tell me about until after the fact and we basically had to start the process over. I received no compensation or even an apology. She was either let go or quit because I got a phone call after not hearing from her for a month from another member of their team. They then proceeded to ask me for another retainer after not doing a damn thing for me.nnLSS: I lost my case and I now pay child support to a parent who continues to break the Custody agreement. I'm sure this firm has done great work for others, especially those who can throw $55k+ at a problem and make it go away. My time and money was disposable to this firm and I'm worse off because of dealing with them.”

“JB is incredible--transparent, straightforward, and above all, honest! I'm not sure where to start. The entire process was smooth from start to finish, and I especially appreciated the level of organization throughout. I was nervous when I realized I'd need a lawyer because my ex wasn't cooperating. I'd heard so many horror stories about long, drawn-out divorces, and I knew I didn't want that. JB walked me through the process clearly and got results! If you are in need of an honest, professional lawyer and firm you will not regret going with JB and Walters Gilbreath, PLLC!nnThank you so much!”
