Texas Estate Planning & Probate Administration

Preserving Wealth, Protecting Heirs & Guiding Probate under the Texas Estates Code

Estate planning and probate law in Texas provides individuals, families, executives, and business owners with the legal framework to organize their affairs, protect accrued assets, minimize tax exposure, and ensure smooth transfer of generational wealth. Governed by the Texas Estates Code, proper estate planning prevents family disputes and eliminates the delays and expenses of court-supervised intestate administration.

In Texas, a comprehensive estate plan extends beyond a simple last will. It integrates revocable living trusts to manage assets outside of probate, statutory durable financial powers of attorney to authorize trusted fiduciaries during incapacity, medical powers of attorney, living wills (directives to physicians), and HIPAA releases. When a loved one passes away, Texas probate law offers streamlined procedures—such as Independent Administration, Muniment of Title, and Small Estate Affidavits—which can be navigated efficiently with experienced probate counsel.

Key Legal Matters & Services in Estate Planning

Last Will & Testament Drafting

Formulating legally sound attested and holographic wills that appoint independent executors, name guardians for minor children, and dictate specific asset bequests.

Revocable Living Trusts & Asset Protection

Creating revocable and irrevocable trusts to ensure privacy, avoid public probate court records, protect beneficiaries with special needs, and shield generational assets.

Incapacity Planning & Powers of Attorney

Preparing Texas Statutory Durable Financial Powers of Attorney and Medical Powers of Attorney to empower designated agents without guardianship court intervention.

Independent & Dependent Probate Administration

Guiding named executors through Texas probate courts to prove the will, publish notices to creditors, inventory estate assets, and distribute inheritances.

Muniment of Title & Small Estate Affidavits

Utilizing cost-effective, expedited Texas probate procedures when estates have no outstanding debts other than real property liens.

Fiduciary Litigation & Will Contests

Resolving contentious probate disputes involving allegations of lack of testamentary capacity, undue influence, executor breach of fiduciary duty, or contested heirship determinations.

Estate planning counsel crafts customized legal instruments to protect family legacies, prevent court delays, and ensure your wishes are executed smoothly.

Texas Real Estate & Property Law

Residential, Commercial & Land Transactions under the Texas Property Code

Real estate law in Texas governs the acquisition, financing, leasing, development, and dispute resolution for residential, commercial, agricultural, and industrial properties across the state. Under the Texas Property Code, real estate transactions involve substantial financial commitments and strict statutory formalities regarding title conveyances, warranty deeds, lien priorities, and disclosures.

Whether navigating commercial development in expanding metropolitan corridors, farm and ranch acquisitions, residential title defects, or commercial lease negotiations, qualified real estate legal counsel safeguards property investments. Texas attorneys examine title commitments, draft customized closing instruments, establish easements and covenants, resolve boundary and survey discrepancies, and litigate property disputes in district courts.

Key Legal Matters & Services in Real Estate Law

Commercial Real Estate Acquisitions & Sales

Structuring purchase and sale agreements, environmental due diligence, zoning reviews, financing documents, and closing oversight for commercial assets.

Residential Conveyancing & Title Examination

Resolving clouds on title, mechanics liens, heirship affidavits, warranty deeds, deeds of trust, and Texas homestead protections.

Commercial Leases & Tenant Covenants

Drafting and negotiating triple net (NNN) leases, gross leases, tenant build-out covenants, and CAM reconciliations for office, retail, and industrial spaces.

Landlord-Tenant Law & Eviction Proceedings

Representing property managers and landlords through notice to vacate compliance, Justice of the Peace (JP) court eviction hearings, and appeals.

Easements, Boundaries & Title Disputes

Litigating boundary line conflicts, prescriptive easements, trespass to try title actions, adverse possession claims, and right-of-way negotiations.

HOA & Property Owners Association Law

Advising on restrictive covenant enforcement, developer declarant rights, and compliance with Chapter 209 of the Texas Property Code.

Real estate attorneys secure property titles, draft airtight conveyances, and litigate disputes to protect your land, commercial assets, and residential investments.

“I had an excellent experience with Fleischmann and Shutt Law Firm. From the very beginning, the process was professional, clear, and extremely thorough.nnTheir office is beautiful, clean, and welcoming, and the waiting area is very cozy and comfortable. We were greeted by two lovely receptionists who welcomed us with genuine hospitality and made us feel at ease right away.nnAttorney Audra Apke took the time to walk my family through every option for our estate planning needs and made sure we fully understood what would work best for our situation. She was patient, knowledgeable, and truly cared about getting everything done correctly.nnWe completed a flat-rate estate planning package that included a will plus additional documents and two Transfer on Death Deeds (TODDs) for my mother and stepfather, with me as the primary beneficiary and my son as the secondary. Everything was organized, efficient, and gave us real peace of mind.nnPrice-wise, everything was upfront and transparent -- no surprises. And on top of that, Audra even provided my father-in-law's Power of Attorney documents for FREE (yes, FREE -- a true unexpected bonus).nnIf you're looking for a trustworthy, thorough, and highly professional estate planning law firm, I strongly recommend Fleischmann and Shutt. Outstanding service from start to finish.nnThank you, Attorney Audra.nThank you, Fleischmann and Shutt Law Firm.nnGod Bless.nnJeremy S., RN”

“My experience after the firm merged earlier this year was not good. I was assigned a new attorney without any notice in the middle of my application. I constantly had to chase the attorney for updates on my case. My calls and emails were often left unanswered. I would not recommend this firm post merger.”

“I am extremely disappointed with my experience at this law firm. From the very beginning, I was transparent about my goal: to transfer my late father's property into my name. I was initially working with Attorney Brittney and informed her that my siblings had ZERO interest in the property. She advised me that completing an affidavit of heirship was the appropriate step, which I promptly did. During the process, however, I was informed that Attorney Brittney was no longer with the law firm due to unprofessionalism and/or unjust practices. It was my decision at that time to continue working with the law firm and not with Attorney Brittney, due to the law firm's reputation and its high recommendation. I then began working with Attorney Audra. Everyone seemed to be nice and professional; however, after the firm accepted my payment and completed the affidavit, I noticed that the property was listed in my siblings' names and not mine. I was informed by Attorney Audra that, due to Texas state laws, the property could not be transferred into my name. What is most frustrating is that this information--fundamental to my situation--was never disclosed to me beforehand. As a client, I trusted the attorney to provide clear guidance on whether my objective was even legally possible before taking my money. Hello? I am a nurse, not an attorney. This was the reason I sought legal advisement. Instead, I was left with an incomplete solution that does not resolve the issue I initially sought help for. Clients deserve honesty and full disclosure upfront. While I understand that legal processes can be complex, failing to provide critical information until after payment creates the impression that the firm prioritizes fees over transparency. I would encourage anyone considering this firm to ask very direct questions and insist on written confirmation of what can and cannot be accomplished before moving forward.nnAsk ChatGPT”
