2 Practice Disciplines

Criminal Defense & Constitutional Advocacy

Defending Constitutional Rights in Texas Municipal, County & District Courts

Facing criminal charges in Texas places an individual's freedom, reputation, employment, and constitutional liberties under direct threat from the formidable resources of state or federal prosecutors. Under the Texas Penal Code and the Texas Code of Criminal Procedure, criminal allegations range from Class C misdemeanors through first-degree and capital felonies that carry severe mandatory prison sentences and life-altering collateral consequences.

Effective criminal defense requires immediate intervention and proactive constitutional scrutiny. Seasoned Texas criminal defense attorneys examine every phase of the state's case: evaluating whether law enforcement had reasonable suspicion for initial traffic stops, probable cause for warrantless searches or arrests, adherence to Miranda warnings, chain of custody for physical evidence, and compliance with statutory blood and breath testing protocols. Early defense representation allows counsel to engage prosecutors before grand jury indictments, negotiate bond reductions at magistrate hearings, file motions to suppress illegally obtained evidence, and present robust defenses before Texas juries.

Key Legal Matters & Services in Criminal Defense

DWI / BWI & Impaired Driving Defense

Challenging Standardized Field Sobriety Tests (SFSTs), breathalyzer calibrations, warrantless blood draws, and ALR administrative driver license suspension hearings.

Drug Offenses & Controlled Substances

Defending possession, distribution, and manufacturing charges involving controlled substances and pharmaceuticals under the Texas Health and Safety Code.

Assault & Family Violence Allegations

Resolving allegations of misdemeanor assault, felony aggravated assault, continuous violence against the family, and defending against emergency protective orders (EPOs).

Theft, Robbery & White-Collar Offenses

Representation for shoplifting, grand theft, credit card abuse, fraud, embezzlement, forgery, and identity theft allegations in Texas district courts.

Felony Indictments & Weapons Violations

Defense against serious felony indictments, unlawful carrying of weapons, firearm charges, burglary, evading arrest, and violent crime allegations.

Record Expunctions & Non-Disclosure Orders

Clearing eligible arrest records, dismissing deferred adjudication charges, and sealing criminal records to restore civil liberties and background check clearance.

Experienced defense counsel investigates procedural violations, cross-examines state witnesses, and advocates vigorously to protect your freedom and future.

United States Immigration & Nationality Law

Navigating USCIS, Consular Processing & Removal Defense in Texas

Immigration law is an exclusively federal practice that touches the lives of thousands of families and businesses across Texas. Because immigration law is governed by the Immigration and Nationality Act (INA) and federal administrative regulations, attorneys represent clients before the United States Citizenship and Immigration Services (USCIS), Executive Office for Immigration Review (EOIR) immigration courts, and U.S. consulates globally.

In a state with extensive international trade and vibrant immigrant communities, immigration counsel is vital for preserving family unity and securing legal status. Legal representation encompasses family-based immigrant visa petitions, green card adjustments of status, naturalization and citizenship interviews, waivers of inadmissibility, DACA renewals, affirmative and defensive asylum petitions, and bonded removal defense in Texas detention facilities.

Key Legal Matters & Services in Immigration Law

Family-Based Petitions & Green Cards

Filing Form I-130 petitions for spouses, parents, and children of U.S. citizens and permanent residents, followed by Adjustment of Status (AOS) or consular processing.

Deportation & Removal Defense

Aggressive representation in Texas immigration courts (San Antonio, Houston, Dallas, El Paso) for bond hearings, cancellation of removal, and withholding of removal.

Asylum & Humanitarian Relief Applications

Guiding clients through credible fear interviews, affirmative asylum filings before USCIS, defensive asylum in court, and U-Visas for crime victims.

Citizenship & Naturalization (Form N-400)

Preparing naturalization packages, addressing continuous residence inquiries, tax compliance, and representation during USCIS examiner interviews.

Employment & Investor Visas (H-1B, L-1, E-2)

Securing H-1B, L-1, TN, O-1, and E-2 investor visas for professionals, managers, and multinational executives operating in Texas.

Waivers of Inadmissibility (I-601 / I-601A)

Structuring provisional unlawful presence waivers demonstrating extreme hardship to qualifying U.S. citizen relatives.

Dedicated immigration attorneys provide knowledgeable federal advocacy to protect immigrant rights, unite families, and facilitate business visa compliance.

“My loved one was officially booked into the Montgomery ICE Processing Center on January 29, 2026. After having no luck with several lawyers and spending money without results, we finally decided to go with Rivera and Bujosa Law Office.nnWe hired them on March 3, 2026, and that same day the attorney personally went to visit him. Long story short, he was released on April 1, 2026, through a habeas corpus.nnWe are extremely grateful to Mr. Octavio and his team. The staff, especially the ladies, Ms. Keyla and Mr. Carlos, were incredibly helpful and patient with our many questions and concerns.nnI would definitely recommend their services.”

“SCAM they don't care . 0 Stars if I could.nnWe paid this law office $500 on January 5 to represent an immigration detainee. After one initial meeting with him, they completely disappeared. No calls returned, no emails, no updates--nothing.nn(When they would answer they would just say they will call us back and NEVER would)nnHis immigration court date was February 3, and this office did not even know the court date was approaching. They made no effort to prepare us or the detainee in any way. Despite repeated attempts to contact them, we were ignored and ultimately had to drive to the office in person, where it was clear they were uninformed and unprepared about the case.nnThis level of negligence in a detained immigration case is unacceptable. When someone's freedom is on the line, silence and incompetence are not mistakes--they are failures. We trusted this office and were completely let down. I strongly advise others to look elsewhere.”

“0 starts of I could. Do not believe the good reviews these attorneys have. This law office is completely unprofessional and incompetent. Communication was nonexistent -- calls and messages were ignored, and when we finally reached someone, it was obvious they had no idea who we were or what our case was about.nnWe paid $500 and received absolutely nothing of value in return. No updates, no guidance, no preparation -- just confusion and excuses. If this is how they handle clients, it's alarming that they are allowed to practice law at all.nnSave yourself the stress, wasted time, and lost money. Do not trust this office with your legal matters.”
