Civil Tort Claims, Negligence & Physical Injury Recovery in Texas

In Texas, personal injury law provides a critical legal pathway for individuals who have suffered bodily harm, emotional trauma, or catastrophic losses due to the negligence, carelessness, or intentional misconduct of another party. Under Texas civil tort law and the Texas Civil Practice and Remedies Code, injured victims have the legal right to pursue full compensation for their economic damages—such as emergency medical treatment, surgeries, hospital stays, physical therapy, and lost past and future wages—as well as non-economic damages including physical pain, mental anguish, physical impairment, and disfigurement.

Texas operates under a modified comparative fault rule (proportionate responsibility under Chapter 33 of the Texas Civil Practice & Remedies Code). This means an injured plaintiff can recover damages as long as their share of liability is 50% or less, though their financial recovery is reduced by their allocated percentage of fault. Navigating insurance claims against major carriers requires rigorous case building: securing police crash reports, obtaining black-box telematics, interviewing witnesses, subpoenaing surveillance footage, consulting independent medical and accident reconstruction experts, and preparing compelling trial exhibits for Texas county and district courts.

“I reached out to Nachawati Law Group on January 30, seeking representation for a workers' compensation case based on a friend's highly positive recommendation. Unfortunately, my experience was far from satisfactory.nAfter calling around 5:51 PM, I was transferred to an intake specialist. While she introduced herself at the beginning of the call, I struggled to retain her name due to a recent heart issue. When I asked for her name again, she refused to provide it. I inquired about when I could expect a follow-up call--whether Monday morning or afternoon--but felt as though my business was not valued. My frustration grew, and I expressed this clearly, yet she remained unhelpful and simply took my phone number before abruptly hanging up.nFeeling dismissed and disrespected, I decided to seek legal representation elsewhere, despite my understanding that Anne Saucer is a well-regarded attorney in this field. However, I want to acknowledge Timothy, who demonstrated professionalism and honesty during our interaction, even though he couldn't guarantee a callback time.nI followed up to ensure my contact information was noted, fearing it might have been lost due to the previous intake specialist's unprofessional attitude. Unfortunately, this experience has left me feeling disheartened about the service at Nachawati Law Group and will continue my search for a workers comp/ personal injury attorney.”

“Giving a two star review because I think my attorney did anything to get the best he could for me, but as far as communication I give this place a fat ZERO stars. Nobody answers emails/texts, and even calls half the time. It takes at least a week for someone to get back to you. I get this is a large corporation but when you're assigned someone, it shouldn't take that long to get back with you. If you're big on communication like myself-- I would look elsewhere.”

“My experience thus far has been good in recent years as I am now able to speak directly with a lawyer or representative of the law firm about my case. The later years were very difficult and challenging for me as I was unable to reach anyone at all which was quite frustrating. The only person that I was able to speak with during those difficult and challenging times was Ms. Etta Bagley. She understood what l was going through with my illness. She treated me with the utmost respect, dignity, compassion, and unconditional love, that kept me strong throughout the years that I have been dealing with this issue.”

“I contacted them back in 2019 & still nothing. They don't keep in contact with me. I have CLL, went through chemo & now have a thyroid problem, from the chemo. Cancer, does not run in my family. I used Round Up, for many years. When I developed CLL, I had to stop cutting grass, etc. Stay out of the heat & sun.”

She is truly an excellent employee and in my view a very knowledgeable and valuable resource to your staff. I appreciate her insight and patience she has shown me during our conversation. I can only hope that this very special and special person is appreciated.”
