Civil Tort Claims, Negligence & Physical Injury Recovery in Texas

In Texas, personal injury law provides a critical legal pathway for individuals who have suffered bodily harm, emotional trauma, or catastrophic losses due to the negligence, carelessness, or intentional misconduct of another party. Under Texas civil tort law and the Texas Civil Practice and Remedies Code, injured victims have the legal right to pursue full compensation for their economic damages—such as emergency medical treatment, surgeries, hospital stays, physical therapy, and lost past and future wages—as well as non-economic damages including physical pain, mental anguish, physical impairment, and disfigurement.

Texas operates under a modified comparative fault rule (proportionate responsibility under Chapter 33 of the Texas Civil Practice & Remedies Code). This means an injured plaintiff can recover damages as long as their share of liability is 50% or less, though their financial recovery is reduced by their allocated percentage of fault. Navigating insurance claims against major carriers requires rigorous case building: securing police crash reports, obtaining black-box telematics, interviewing witnesses, subpoenaing surveillance footage, consulting independent medical and accident reconstruction experts, and preparing compelling trial exhibits for Texas county and district courts.

“My Attorney, Jacob, was did a terrific job. He was knowledgeable and understanding. His communication skills were top notch. Mr. Jacobs assistant, Mr. Lloyd , was amazing to work with as well. Pleasant and fun to work with also great communication skills. Kaitlyn and the secretary in Shreveport also played a big role with all the pleasantries I encountered working with this company. They also have great personalities, are easy to work with and their communication skills are off the charts as well. This team works great together and truly knows the meaning of teamwork to make a bad situation easier to deal with.nAll of you, thank you for all your hard work. It truly was a great pleasure working with all of you . I will definitely use you if I need to In the future ( sure hope I don't) and you most definitely have every recommendation I have to give.”

“Extremely friendly wonderful people would definitely recommend. First time I have ever been in a car accident where not only I was hurt bad enough to go to the hospital, but both of my kids were with me. The insurance company had sent me a bunch of papers dealing with the claim for the accident. I was very overwhelmed with all the paperwork and physically not doing well let alone mentally not doing well and had no idea how to handle things. Miss Eve was absolutely amazing she would catch me on some days where I was having a not so great day mentally because of everything that was going on and simply just listen to me, which I know it's not part of her job, but just to have that was a true testimony, but how amazing of a person she really was. Thank you, Eve and Morrison Bart for absolutely everything you have done for me and my children”
