Personal Injury Law

Civil Tort Claims, Negligence & Physical Injury Recovery in Texas

In Texas, personal injury law provides a critical legal pathway for individuals who have suffered bodily harm, emotional trauma, or catastrophic losses due to the negligence, carelessness, or intentional misconduct of another party. Under Texas civil tort law and the Texas Civil Practice and Remedies Code, injured victims have the legal right to pursue full compensation for their economic damages—such as emergency medical treatment, surgeries, hospital stays, physical therapy, and lost past and future wages—as well as non-economic damages including physical pain, mental anguish, physical impairment, and disfigurement.

Texas operates under a modified comparative fault rule (proportionate responsibility under Chapter 33 of the Texas Civil Practice & Remedies Code). This means an injured plaintiff can recover damages as long as their share of liability is 50% or less, though their financial recovery is reduced by their allocated percentage of fault. Navigating insurance claims against major carriers requires rigorous case building: securing police crash reports, obtaining black-box telematics, interviewing witnesses, subpoenaing surveillance footage, consulting independent medical and accident reconstruction experts, and preparing compelling trial exhibits for Texas county and district courts.

“Sheesh! I probably should've read these reviews before hiring them. I also should've realized that if it took them weeks to respond with an offer of representation after initial contact, they probably weren't the best firm to be represented by. But here we are! Overall, the communication is just horrible. & their representatives are very condescending & don't know what it means to hold themselves accountable. Spoke to Ms. Angela Bravo regarding my case last year. She was VERY disrespectful. Ended up having to speak to her again recently regarding an address change. I could barely get a word in edgewise. She is very combative & I think she might believe she's psychic too, the way she doesn't utilize her active listening skills or feel the need to actually LISTEN. It was me with the concerns, yet as soon as we got on the phone this last time she started rambling for a few minutes. I waited until she stops before I started speaking. She kept cutting me off. I literally had to raise my voice to ask her to stop talking over me. I mentioned how disrespectful she was during our conversation last year & conveniently enough, she caught a case of amnesia. Now this whole time I've been under the impression that I'm to speak to Jessica Martin. Mind you, getting any updates or communication from her is rare. I raised my concerns about my case & how I've been handled to Jessica recently. Went in one ear & right out the other. But after reading some of these other reviews, as well as the firm's tone-deaf/unapologetic responses, I guess that was to be expected. In my humble opinion, please make sure you are doing your research before hiring any firm to represent you. Especially this one. Because I sure wish I had. But never again! 0/10...highly DON'T recommend!!!”

“Hello my name is Charles, I would like to share an express my gratitude and appreciation for kirkendahl Dwyer LLP and a certain employee Kendrea Brandt for all their help, especially to Kendrea for her dedication when it came to resolving my year long battle with the social security administration.nOn April 9th 2026 I reached out to Kirkendall regarding this issue, I was very satisfied with Kendrea she guaranteed she was see what she could find out and call me back before the end of the day. To my surprise that's exactly what she did, she called and told me not to worry she was going to resolve my issue and immediately I felt a weight lifted off of my shoulders. Not only was this done in a very timely manner she also made me feel very comfortable in speaking with her, due to my speech impairment I get very frustrated with myself. Causing the communication on my behalf not to be good because of the insecurities I have... But nope not with her she was amazing I would definitely recommend her and the company to friends and family well to anybody as far as I'm concerned 5 stars all the way.nSo now here we are not even a month later and I have just been notified everything will be taken care of within the next two weeks. The resolution is by far better then I had ever expected. Thank you so much Kendrea and the others that also put in work. You all are amazing. 5+ nnTHANKYOUnCharles S.”

“I hired you several months ago and haven't heard from anybody yet either from my caseworker or the firm. I've left messages and no response. Please advise if I need to hire another attorney or do this on my own!”

“Other reviews are correct in saying this firm fails to respond in any manner, and correct in saying that this firm leaves customers no other option except to do the employees jobs for them. If able, choose another firm - months go by without contact from them, even if you call or email with a message.”

“I had contacted them regarding a st disability claim, after 2 years and 2 denials, they still called me trying to resubmit the case, I told them no thanks, they almost insisted...but its hopeless and I just want them to leave me alone. It seems the reviews are all about the same as mine, they have drug this out over 2 years. Done nothing...none of my doctors have ever heard anything from anyone at this law firm, we did initial paperwork, then a token call once a year from a case manager I've never heard of, but other than that, I did all the work, there was no one at a hearing. They b are just so overwhelmed with clients maybe that alot of people fall thru their huge cracks...look for a local attorney, not this giant firm, cuz you won't get anything done with them. They called today, after I sent emails saying I didn't want them any longer, and didn't tell me who they were or why they were calling, just started asking for my social security number and date of birth, I told them I dont give that info over the phone, she laughed and said it was ok...I hung up...to find out who they were I had to look up the number and call them back to fire them over the phone...useless...got nothing done at all!!”
