Personal Injury Law

Civil Tort Claims, Negligence & Physical Injury Recovery in Texas

In Texas, personal injury law provides a critical legal pathway for individuals who have suffered bodily harm, emotional trauma, or catastrophic losses due to the negligence, carelessness, or intentional misconduct of another party. Under Texas civil tort law and the Texas Civil Practice and Remedies Code, injured victims have the legal right to pursue full compensation for their economic damages—such as emergency medical treatment, surgeries, hospital stays, physical therapy, and lost past and future wages—as well as non-economic damages including physical pain, mental anguish, physical impairment, and disfigurement.

Texas operates under a modified comparative fault rule (proportionate responsibility under Chapter 33 of the Texas Civil Practice & Remedies Code). This means an injured plaintiff can recover damages as long as their share of liability is 50% or less, though their financial recovery is reduced by their allocated percentage of fault. Navigating insurance claims against major carriers requires rigorous case building: securing police crash reports, obtaining black-box telematics, interviewing witnesses, subpoenaing surveillance footage, consulting independent medical and accident reconstruction experts, and preparing compelling trial exhibits for Texas county and district courts.

“First I want to say that I am not a client and only call to get a second opinion. Which Mr. Grant did, in fact he gave me 45 minutes of free advice on my case. What he told me sadly for me was what my actual lawyer told me. But he did give me some advice on where to go and a few new ideas to bring up with my lawyer. He also gave me a way to make sure that I can hold my lawyer accountable. To be honest I wish I had called him first. But the information he gave was priceless.”

“Highly recommend this law firm! Back on st. Patrick's day 2025 I was on my way home from work when someone pulled out of a place of business on rt 69 and stuck my vehicle twice. My car was completely totaled. My wife got a recommendation for this law firm and from the moment we met with Mr. Grant and his team we knew they were exactly who we needed. They took care of absolutely everything for us. They truly went above and beyond for us and I'm incredibly thankful! Thank you Mr. Grant and your amazing team for helping me get my life back after such a stressful situation!nSincerely,nThe Meier Family”

“My husband and I were in a minor car accident. At first, I tried calling the insurance company of the person who ran into us by myself. I got no where with them-not even a call back! So, a little out of anger and, a little out of principle, I took a chance and called Grant and Flannery. Matt Flannery met with us personally, and listened to our story. His office made arrangements for us to start our treatment. Throughout the process, they made it a point to check-in on both of us. Today, we received our settlement-and no, we are not millionaires- it was never going to be one of those exceptional cases; but that brings me to my point- knowing this was not going to be the case of year, they still treated us with the utmost respect and professionalism and never made us feel we were not important. It was refreshing building a relationship with Matt and his staff. I would be remiss if I didn't mention the patience and always prepared Julia . She was an absolute delight to deal with. Thank you to Matt, Julia and the rest of the Grant and Flannery team for making my husband and I whole again.”

“Darren Grant met with us this morning. He and his staff were very helpful. He answered all of our questions in a manner we could understand, not talking down to us but talking with us. He was very patient and gracious with his time. We left their office knowing that everything was going to be okay. He and his law partner Mathew Flanery are who I would recommend if you ever find yourself in need of a good and honest lawyer.”
