Texas Bankruptcy & Debt Relief Law

Chapter 7, Chapter 13 & Creditor Defense in Texas Federal Bankruptcy Courts

When individuals and businesses face insurmountable debt, wage garnishments, foreclosure notices, or creditor harassment, federal bankruptcy protection offers a structured legal reset. Practicing in the federal Northern, Southern, Eastern, and Western Districts of Texas, bankruptcy attorneys guide debtors through the protections of Title 11 of the United States Code.

Texas is widely recognized for having some of the most debtor-friendly exemption laws in the United States. Under Chapter 41 and 42 of the Texas Property Code, debtors can protect their primary residence with an unlimited dollar homestead exemption (subject to acreage limits), as well as substantial personal property, retirement accounts, and tools of the trade. Filing a bankruptcy petition triggers the immediate "automatic stay" under 11 U.S.C. § 362, legally prohibiting creditors from continuing debt collection lawsuits, foreclosures, or repossessions.

Key Legal Matters & Services in Bankruptcy Law

Chapter 7 Liquidation Bankruptcy

Eliminating qualifying unsecured credit card debt, personal loans, and medical bills for income-eligible debtors under the means test.

Chapter 13 Debt Reorganization Plans

Creating structured 3 to 5-year repayment plans that halt home mortgage foreclosures, cure arrears, restructure vehicle loans, and repay tax obligations.

Homestead & Personal Property Exemptions

Maximizing Texas statutory exemptions to protect primary family homes, personal vehicles, jewelry, firearms, and household goods.

Automatic Stay Enforcement & Creditor Defense

Stopping abusive debt collectors, creditor harassment, bank levies, vehicle repossessions, and pending foreclosure auctions immediately upon filing.

Chapter 11 Business Reorganizations

Reorganizing commercial debts, restructuring commercial leases, and preserving corporate operations through federal Chapter 11 and Subchapter V filings.

Adversary Proceedings & Creditor Defense

Defending nondischargeability lawsuits, stripping junior liens on investment properties, and disputing predatory creditor claims.

Bankruptcy attorneys provide compassionate guidance to halt creditor harassment, protect family assets, and guide clients toward financial independence.

“I recently filed for bankruptcy (Just discharged!). I checked out a few different law firms, and when speaking with one of the lawyers from Graham legal, they just seemed like they gave me the best feeling if that makes sense. The lawyer i spoke with was very knowledgeable and reassuring. After I began, they were able to answer any and all of my questions, help me with processing the paperwork, and walked me through the entire process.nnThere was no hiccups or any issues that arise. I would definitely recommend using them to anyone needing to file a bankruptcy.”

“Bankruptcy is scary. Never thought I would have to file. However, with my husband losing his leg, bills just became too much on one income. Thankfully, Graham Legal was able to help us go through the process smoothly and efficiently. Contact was superb and they answered every question we had.”

“Called and left a detailed message with my name and phone number. Got a call 3 minutes later. The gentleman on the phone never listened to the message I left so he didn't know my name or why I called. What is the point of leaving a message if you don't listen to it. Very unprofessional. A good law firm is about the details. Very disappointed as this firm gets good reviews. Need to do much better with the opening process of obtaining a client. Calling a potential client back by using his name is a good start.”
