Civil Tort Claims, Negligence & Physical Injury Recovery in Texas

In Texas, personal injury law provides a critical legal pathway for individuals who have suffered bodily harm, emotional trauma, or catastrophic losses due to the negligence, carelessness, or intentional misconduct of another party. Under Texas civil tort law and the Texas Civil Practice and Remedies Code, injured victims have the legal right to pursue full compensation for their economic damages—such as emergency medical treatment, surgeries, hospital stays, physical therapy, and lost past and future wages—as well as non-economic damages including physical pain, mental anguish, physical impairment, and disfigurement.

Texas operates under a modified comparative fault rule (proportionate responsibility under Chapter 33 of the Texas Civil Practice & Remedies Code). This means an injured plaintiff can recover damages as long as their share of liability is 50% or less, though their financial recovery is reduced by their allocated percentage of fault. Navigating insurance claims against major carriers requires rigorous case building: securing police crash reports, obtaining black-box telematics, interviewing witnesses, subpoenaing surveillance footage, consulting independent medical and accident reconstruction experts, and preparing compelling trial exhibits for Texas county and district courts.

“Review for Push & Wynne (formerly Push & Nguyen)nnI am sharing this review based solely on my family's personal experience with this firm.nnWe initially retained the firm when it was operating as Push & Nguyen. After representation began, the firm later changed its name to Push & Wynne, which we understood to be due to a change in partnership. This transition occurred while my mother's case was ongoing.nnThroughout the representation, we experienced consistent challenges with communication. Calls and messages were often not returned in a timely manner, and it was difficult to obtain clear or consistent updates regarding the status of the case. On several occasions, I reached out to multiple staff members and supervisors in an effort to get information, but communication issues persisted.nnThere were also concerns regarding documentation and accuracy of information. Some of the information the firm had on file for my mother appeared to be incorrect, including addresses that we did not recognize or provide. Additionally, certain documents and paperwork we expected to receive were delayed or not provided to us at all.nnRegarding fees, we were initially advised that the contingency fee would be approximately 33%. Later, we were informed that the fee had increased to 45%, and then adjusted to 40%, which we were told was due to the case being taken into litigation. These changes were confusing to us and not clearly explained at the time.nnAfter more than a year, we were advised that the case required litigation. Ultimately, my mother received approximately $5,600 from the settlement. We were informed that the attorneys retained approximately $10,000, with the remaining amount allocated to medical expenses. Based on the communication challenges we experienced throughout the case, it was difficult for us to fully understand or verify the breakdown without additional clarification.nnOverall, our experience was disappointing. We felt there was a lack of consistent communication, organization, and transparency, which made it difficult to feel informed or supported during an already stressful time.nnI recommend that anyone considering this firm carefully review all agreements, ask detailed questions upfront, and ensure they are comfortable with the level of communication they may receive.”

“I had a car accident 8/25/22 and my case has not been resolved despite multiple assurances from the Pusch and Nguyen team. I signed the final settlement agreement April 2025 and was told to expect a check shortly. I have followed up with them several times over the past year to see when I could expect my check and every time I get the run around. Whenever I call, they always tell me the person I need to speak to is not available but will call me back. They never call back . I have also tried emailing many times and have been told on multiple occasions that they will speak with the accounting department and I should have a check by the end of the week. The most recent time I was told this was by Brenda in an email on 3/9/26. I never heard back. Since then, I have sent 3 follow up emails to Brenda which have all been ignored. I have called the office twice since then and was told I would get a call back, but no one ever calls me back.nnElizabeth Waddell”
