2 Practice Disciplines

Texas Labor & Employment Law

Workplace Rights, Discrimination Defense & Executive Contracts

Employment law in Texas operates at the intersection of federal statutes and the Texas Labor Code, establishing the rules that govern the employer-employee relationship. While Texas is an "at-will" employment state, both state and federal law impose critical protections against unlawful discrimination, retaliation, wage theft, and breaches of employment agreements.

Employment attorneys represent both employees whose rights have been infringed and businesses seeking to maintain lawful, compliant employment practices. Representation covers claims under Title VII of the Civil Rights Act, the Americans with Disabilities Act (ADA), the Age Discrimination in Employment Act (ADEA), and Chapter 21 of the Texas Labor Code, as well as wage claims before the Texas Workforce Commission (TWC) and U.S. Department of Labor (DOL).

Key Legal Matters & Services in Employment Law

Workplace Discrimination & Harassment

Investigating and litigating claims of discrimination based on race, gender, pregnancy, national origin, religion, disability, or age in Texas workplaces.

Retaliation & Whistleblower Protections

Defending workers terminated or demoted for reporting illegal employer conduct, filing workers' comp claims, or reporting safety violations.

Wage & Hour / Overtime Claims (FLSA)

Recovering unpaid overtime, misclassified independent contractor wages, tip pooling violations, and off-the-clock labor claims.

Executive Severance & Employment Contracts

Negotiating executive compensation packages, separation agreements, equity participation, and severance release terms.

Non-Compete & Restrictive Covenants

Enforcing or challenging non-compete agreements under the Texas Covenants Not to Compete Act (Tex. Bus. & Com. Code § 15.50).

TWC & EEOC Administrative Hearings

Representing parties in formal EEOC intake, mediation, position statement filings, and Texas Workforce Commission unemployment hearings.

Employment lawyers protect workplace fairness, investigate unlawful termination, and negotiate executive compensation packages across Texas.

Personal Injury Law

Civil Tort Claims, Negligence & Physical Injury Recovery in Texas

In Texas, personal injury law provides a critical legal pathway for individuals who have suffered bodily harm, emotional trauma, or catastrophic losses due to the negligence, carelessness, or intentional misconduct of another party. Under Texas civil tort law and the Texas Civil Practice and Remedies Code, injured victims have the legal right to pursue full compensation for their economic damages—such as emergency medical treatment, surgeries, hospital stays, physical therapy, and lost past and future wages—as well as non-economic damages including physical pain, mental anguish, physical impairment, and disfigurement.

Texas operates under a modified comparative fault rule (proportionate responsibility under Chapter 33 of the Texas Civil Practice & Remedies Code). This means an injured plaintiff can recover damages as long as their share of liability is 50% or less, though their financial recovery is reduced by their allocated percentage of fault. Navigating insurance claims against major carriers requires rigorous case building: securing police crash reports, obtaining black-box telematics, interviewing witnesses, subpoenaing surveillance footage, consulting independent medical and accident reconstruction experts, and preparing compelling trial exhibits for Texas county and district courts.

Key Legal Matters & Services in Personal Injury

Motor Vehicle & Commercial Trucking Collisions

Comprehensive representation for commercial 18-wheeler collisions, delivery fleet crashes, car wrecks, motorcycle collisions, and rideshare (Uber/Lyft) accidents across Texas interstates (I-35, I-10, I-45).

Catastrophic Brain, Spinal & Burn Injuries

Dedicated advocacy for traumatic brain injuries (TBI), spinal cord severing, quadriplegia, paraplegia, and severe burn injuries requiring lifelong medical care and structured life care plans.

Premises Liability & Property Hazards

Pursuing negligent property owners, commercial landlords, retail stores, and hotels for hazardous conditions, inadequate security, slip and falls, structural collapses, and dog attacks under Texas premises liability law.

Wrongful Death & Survival Actions

Representing surviving spouses, children, and parents under the Texas Wrongful Death Act to secure financial stability and accountability following fatal negligence.

Workplace & Industrial Job Site Accidents

Legal representation for non-subscriber workplace accidents, refinery explosions, drilling rig failures, and construction site incidents across Texas industrial sectors.

Insurance Bad Faith & Trial Litigation

Confronting commercial insurance adjusters attempting to undervalue, delay, or deny valid claims, advancing to jury trials when settlement negotiations fail.

Legal counsel in Texas personal injury claims investigates liability, gathers medical proof, negotiates with insurers, and presents evidence to achieve fair compensation for clients.

“Was referred to this attorney Margo Pillischer by a personal referral. Despite ample information and recounting my story, they did not help me. So disappointed to feel hopeful to have support while sharing details and information regarding some of the most difficult experiences I've ever had. While I understand the law firm may just conceptualize this as discernment on who they can take on, it's actually incredibly traumatic and emotionally harmful to have to share this consistently and then to have the firm not explore the very serious and real legal issues further with no clarity about why or why not. So disappointed and discouraged, especially when they claim on their site to help the exact kind of situation I'm in. I was never even offered a consultation. Ended up settling it on my own and am pleased with the outcome I got MYSELF while saving $$ so win win for me, and lose lose for them.”

“Very disappointed - poor communication, rude interactions, and weeks without a response on our case. On the discovery call all details were covered multiple times and only after a 500 dollar consult, 1500 dollar retainer (this was returned) and a month of little to no communication the team decided there wasn't a case because of poor note taking and attention to detail due to something missed at the start. Reached out multiple times to contact our lawyer with no response before finally finding out they were no longer with the company. Finally got a follow up meeting scheduled and they were an hour late and unprepared for the call which is unacceptable. Even the letter we received stating there was no case had misspelled words and my S/Os credentials wrong.”

“Initially, my experience was great. Brandie Moser guided me and helped me every step of the way. The communication was not always great, I found myself having to remind Brandie and the paralegal of certain things on occasion but I understood how much was on their plate so it did not bother. However, when it came time to make a decision on if the partners would move forward with me and trial, Brandie never again reached out. I realized at that point she was no longer my attorney and had zero obligation, however it is disheartening to go to the lengths I did and not receive a response at all on whether the partners thought it was good to take my case or not. I worked with Brandie for months, I thought she genuinely cared about my situation so to be left hanging after the firm received payment is disappointing. I sent MULTIPLE emails asking for clarity and a decision so I can move forward however I need to considering I only have a certain amount of time to file a suit once we received the right to sue. To have to start over is challenging enough and wastes time, but to be ignored instead of simply being told the firm is not able to help me leaves a sour taste and unfortunately detours how good my experience initially was.”
