Texas Estate Planning & Probate Administration

Preserving Wealth, Protecting Heirs & Guiding Probate under the Texas Estates Code

Estate planning and probate law in Texas provides individuals, families, executives, and business owners with the legal framework to organize their affairs, protect accrued assets, minimize tax exposure, and ensure smooth transfer of generational wealth. Governed by the Texas Estates Code, proper estate planning prevents family disputes and eliminates the delays and expenses of court-supervised intestate administration.

In Texas, a comprehensive estate plan extends beyond a simple last will. It integrates revocable living trusts to manage assets outside of probate, statutory durable financial powers of attorney to authorize trusted fiduciaries during incapacity, medical powers of attorney, living wills (directives to physicians), and HIPAA releases. When a loved one passes away, Texas probate law offers streamlined procedures—such as Independent Administration, Muniment of Title, and Small Estate Affidavits—which can be navigated efficiently with experienced probate counsel.

Key Legal Matters & Services in Estate Planning

Last Will & Testament Drafting

Formulating legally sound attested and holographic wills that appoint independent executors, name guardians for minor children, and dictate specific asset bequests.

Revocable Living Trusts & Asset Protection

Creating revocable and irrevocable trusts to ensure privacy, avoid public probate court records, protect beneficiaries with special needs, and shield generational assets.

Incapacity Planning & Powers of Attorney

Preparing Texas Statutory Durable Financial Powers of Attorney and Medical Powers of Attorney to empower designated agents without guardianship court intervention.

Independent & Dependent Probate Administration

Guiding named executors through Texas probate courts to prove the will, publish notices to creditors, inventory estate assets, and distribute inheritances.

Muniment of Title & Small Estate Affidavits

Utilizing cost-effective, expedited Texas probate procedures when estates have no outstanding debts other than real property liens.

Fiduciary Litigation & Will Contests

Resolving contentious probate disputes involving allegations of lack of testamentary capacity, undue influence, executor breach of fiduciary duty, or contested heirship determinations.

Estate planning counsel crafts customized legal instruments to protect family legacies, prevent court delays, and ensure your wishes are executed smoothly.

“I had a most pleasant experience with Texas Trust Law. Melissa Donovan helped my husband and I set up our guardianship for our youngest daughter, a special needs trust plus our regular trust. She explained everything from the cost to how these operate and how they help us going forward into the future for our children. She was thorough and very helpful with questions concerning these documents as our situation is a little more complex. Her aide, Julia, was phenomenal as well getting our documents together and signed in a timely fashion. I thoroughly enjoyed working with them. They are located downtown in a very quiet area which was very pleasantly nice and amazingly easy to get to as well. I highly recommend using this law firm if you have needs related to wills/trusts and special needs/adult care issues/concerns. They can handle all of that with thorough precision.”

Response from Office:

Thank you for the wonderful review. We're so glad Melissa and Julia could guide you through the guardianship, special needs trust, and regular trust and that the process was clear and timely. We appreciate your recommendation and are honored to have helped bring peace of mind for your family's future. Please reach out anytime if you need further assistance.

“We are very pleased with the service provided by Texas Trust Law. Working with Rob and Julia was quite productive and the end product is exactly what we were looking for. Rob is a great listener and very patient in explaining some of the complexities of estate planning. Julia made sure we understood each section of our will and made notes for us of the details we needed to add. I like their flat rate pricing, too. It is very fair and avoids being nickeled-and-dimed to death in a typical by-the-hour arrangement. We enjoyed first class service at an affordable price.”

Response from Office:

John, thank you for the wonderful review. We're thrilled Rob and Julia provided clear, patient guidance and that your will turned out exactly as you wanted. We appreciate your feedback about our flat-rate pricing and are glad it made the process stress-free. We look forward to assisting you with any future estate planning needs.

“We have been with them for almost 18 years. They are absolutely not the cheapest, but they are extremely thorough and have a system setup where they get you to come in to revise your trusts every year (or every 3 years).nnYour life changes and the law is constantly changing as well. It is easy to ignore needing to update your directives, fiduciaries, guardians, add assets etc.nnThe team originally did all the work to move everything into the trust which was very nice.nnWe feel 100% comfortable that our kids will be taken care of if something were to happen to us.”

Response from Office:

Anthony, thank you for trusting us for nearly 18 years and for sharing your experience. We're pleased our thorough approach and review system give you confidence that your children will be cared for and that your documents stay current. It was our pleasure to handle moving your assets into the trust, and we appreciate you highlighting the value of regular updates. We remain committed to providing proactive service and support whenever you need us.
