Personal Injury Law

Civil Tort Claims, Negligence & Physical Injury Recovery in Texas

In Texas, personal injury law provides a critical legal pathway for individuals who have suffered bodily harm, emotional trauma, or catastrophic losses due to the negligence, carelessness, or intentional misconduct of another party. Under Texas civil tort law and the Texas Civil Practice and Remedies Code, injured victims have the legal right to pursue full compensation for their economic damages—such as emergency medical treatment, surgeries, hospital stays, physical therapy, and lost past and future wages—as well as non-economic damages including physical pain, mental anguish, physical impairment, and disfigurement.

Texas operates under a modified comparative fault rule (proportionate responsibility under Chapter 33 of the Texas Civil Practice & Remedies Code). This means an injured plaintiff can recover damages as long as their share of liability is 50% or less, though their financial recovery is reduced by their allocated percentage of fault. Navigating insurance claims against major carriers requires rigorous case building: securing police crash reports, obtaining black-box telematics, interviewing witnesses, subpoenaing surveillance footage, consulting independent medical and accident reconstruction experts, and preparing compelling trial exhibits for Texas county and district courts.

“Think twice before using these Lawyers. Over a month I've tried to get them to answer my calls are least return my calls and nothing. I was supposed to awarded $9,000 for a settlement and when when it it got to the the last leg of of it and I finally think it's going to be over, well much to my surprise that's when they cut off if all contact and now I've no idea what's going on. This is not right. I've left message after message begging for anyone to contact me and yet nothing. First they said they were only taking 30% then 40% guess they decided they wanted it all. This is not right how I've been done. I guess because they are lawyers and know all these little legal loopholes they can treat people however they want and get away with it. While I sit here and do without.”

“Worst law firm, never return calls.A hernia mesh lawsuit case was started in 2018 (nothing happening during covid),you would think as the attorneys handling the case they would know the prerequisites needed to qualify for said case, 5 yrs later and a slap in the face offer I was told my surgeries didn't fall under what was needed to qualify, why I wasn't told 5 yrs ago that my surgeries didn't fall under what was needed is a mystery to me.Very unprofessional, don't return calls, they didn't even have the dates of my surgeries documented right.Incompetence at its finest If you need a attorney please do yourself a favor and seek legal elsewhere”

“I believe you all are handling my case fairly well, seemus to be taking a long time. But I don't know the law either. My doctors all agree that they don't want to take my mesh out, because it could cause me more problems later. I called your office from the doctor appointment and had the doctor ready to explain their reasons whpersy. When I callegd you from there. I made several attempts, only got to leave messages. You wanted information on my mesh and I tried to give it to you, straight from the doctor. Only to be told, when I finally get ahold of the office personnel. That I didn't need to do it. Your waiting for an offer, etc .. I am having a lot of money problems, because of several reasons, would need these cases close ASAP. I was treated with respect and professional attitude by the woman I talked with. Have a good day.nDoug”
