Civil Tort Claims, Negligence & Physical Injury Recovery in Texas

In Texas, personal injury law provides a critical legal pathway for individuals who have suffered bodily harm, emotional trauma, or catastrophic losses due to the negligence, carelessness, or intentional misconduct of another party. Under Texas civil tort law and the Texas Civil Practice and Remedies Code, injured victims have the legal right to pursue full compensation for their economic damages—such as emergency medical treatment, surgeries, hospital stays, physical therapy, and lost past and future wages—as well as non-economic damages including physical pain, mental anguish, physical impairment, and disfigurement.

Texas operates under a modified comparative fault rule (proportionate responsibility under Chapter 33 of the Texas Civil Practice & Remedies Code). This means an injured plaintiff can recover damages as long as their share of liability is 50% or less, though their financial recovery is reduced by their allocated percentage of fault. Navigating insurance claims against major carriers requires rigorous case building: securing police crash reports, obtaining black-box telematics, interviewing witnesses, subpoenaing surveillance footage, consulting independent medical and accident reconstruction experts, and preparing compelling trial exhibits for Texas county and district courts.

“Really can't speak highly enough. Great experience. They jumped on the case immediately and got it dismissed. Once I provided the information they requested (which was all very simple), they took care of everything. Very professional and easy to work with. Wasn't cheap necessarily but very worth it! Would recommend again and again.”

“I feel this law firm operates unprofessionally and unethically. From my experience, they seemed more focused on quick, low settlements and handling high volumes of cases rather than properly representing clients. My attorney hired them to pursue a case against State Farm, but I saw little to no effort on my behalf. They pushed me to accept a $15,000 settlement, and when I said I would only consider settling for $20,000, they didn't even seem willing to negotiate further.nnCommunication was also very poor throughout the process, and the attorney I spoke with acted so unprofessionally that I even questioned whether he was properly licensed to practice law. Overall, I was very disappointed with the lack of effort, communication, and professionalism.”

“Annie Basu is the best attorney! She is very empathetic, highly intelligent, knowledgeable and strategic. She helped me to win my divorce and child custody case and helped my son and myself from my narcissistic ex wife. I am in my current job along with my son only because of her timely decision. I am always grateful to her and Basu law firm.nnI recommend Annie Basu especially for divorce and child custody cases 10/10. She is the best you can ever think of. I only wish her the best”
